- How do I clear outstanding finance before buying?
- Get a written settlement letter from the named lender, dated within 7 days of completion, confirming the balance and the lender's discharge on receipt. Pay the settlement portion to the lender directly, the residual to the seller.
- Does a category marker affect resale as well as purchase?
- Yes. Markers are permanent and surface at every future sale, quote and part-exchange, so the discount taken on the way in has to be weighed against the discount demanded on the way out.
- Will a write-off affect my insurance quote?
- Yes. Cat S and N vehicles typically attract a 20-40% premium loading. The category marker is permanent and declaration is mandatory at every renewal.
- What does 'outstanding finance' mean legally?
- A UK lender has an open agreement against the vehicle. The agreement legally follows the car, not the seller. Buying under outstanding finance can leave the new owner liable to repossession even if they bought in good faith.
- Am I protected if I bought in good faith?
- Only narrowly, and trade buyers are not protected at all. The statutory protection around hire-purchase title is limited, so it should never be relied on as a substitute for checking before payment.
